The National Social Security Fund (NSSF) has initiated further action to secure full possession of all the land it purchased at Temangalo in Wakiso District.

In 2008, NSSF purchased 463.87 acres of land from Arma Limited and Amos Nzeyi. The land, which is comprised of six separate certificates of title, is registered in the name of the Fund, which is in possession of all six certificates of title.

At the time the purchase agreement was signed in 2008, the Fund and one of the vendors, Mr. Amos Nzeyi, also entered into a Memorandum of Understanding (MOU), under which he would retain 104.88 acres containing a farmhouse, paddocks and related developments in exchange for providing the Fund with suitable alternative land within six months.

However, the vendor provided land that did not meet the requirements of the MOU and resisted the Fund’s efforts to take possession of the remaining 104.88 acres. The Fund subsequently sought to recover the 104.88 acres, resulting in a dispute.

In October 2011, the Fund and Mr. Nzeyi attempted to resolve the impasse. It was agreed that Mr. Nzeyi would cede 50 acres, reducing the land to be swapped to 54.88 acres. In return, Mr. Nzeyi undertook to provide 64.5 acres of land to the Fund. However, this position was rejected by the Minister.

In February 2013, Mr. Amos Nzeyi and NSSF agreed to refer the dispute to arbitration to resolve the impasse. The arbitration award upheld the terms of the original MOU and the subsequent negotiated position of the parties. This provided for a swap involving equal and suitable land that was adjacent to land already in the Fund’s possession, appropriate for the Fund’s planned housing developments, and free of squatters.

From 2013 to date, following two independent valuations of the suitability of the alternative land provided by Mr. Nzeyi, the only suitable land identified for the swap is 10 acres.

This prompted the Fund, in June 2026, to issue an ultimatum to Mr. Nzeyi to provide suitable alternative land by June 30, 2026, failing which the Fund would take steps to enforce its rights and take possession of the land.

Following the expiry of the ultimatum, the Fund commenced the process of applying to the High Court for execution of the terms of the land swap by seeking the eviction of Mr. Nzeyi from the 55 acres that form part of the 463 acres purchased by the Fund in 2008 and transferred into its name.

NSSF has reaffirmed its commitment to vigorously protecting the interests of its members, as well as its ownership rights and possession of the land at Temangalo.
