State Urges High Court to Deny Lukwago Bail, Citing Flight Risk and Witness Interference

The Office of the Director of Public Prosecutions (ODPP) has asked the High Court to reject former Kampala Lord Mayor Erias Lukwago’s application for bail, arguing that he has not presented sufficient grounds to justify his release pending trial.

In its response filed through Chief State Attorney Joseph Kyomuhendo, the prosecution says Lukwago’s application lacks merit and disputes several claims made in support of his request.

The State dismisses allegations that Lukwago was assaulted while in detention, forced to perform physical drills and push-ups, or that Murchison Bay Prison is unable to adequately manage his medical condition.

According to the prosecution, any health concerns raised by the accused can be properly handled by the Uganda Prisons Service medical team.

The DPP further argues that Lukwago poses a significant flight risk because he is facing a charge of misprision of treason, an offence punishable by a maximum sentence of life imprisonment upon conviction.

The prosecution contends that granting him bail would increase the likelihood of absconding and jeopardise the ongoing criminal proceedings.

The State also challenges the suitability of Lukwago’s proposed sureties, arguing that they are not substantial enough to guarantee his appearance in court.

Additionally, the prosecution says the witnesses in the case are known to Lukwago and that, given his status as a senior lawyer, politician, former Kampala Lord Mayor, and a leading member of the People’s Front for Freedom, he is capable of influencing or interfering with them.

The DPP further maintains that the charges arise from alleged unlawful activities that threaten the security of the Republic of Uganda, making it contrary to the interests of justice to grant bail.

The prosecution has therefore asked the High Court to dismiss the application, arguing that releasing Lukwago would prejudice the prosecution’s case and undermine the administration of justice.

Justice David Matovu directed both parties to file written submissions and said he will deliver his ruling on the bail application on Thursday, July 30, 2026.

Lukwago was arrested and remanded last month on allegations that he failed to report to authorities an alleged plot by Dr. Kizza Besigye and Hajji Obeid Lutale to overthrow the government using firearms.

He is seeking bail on grounds of ill health, saying he needs to travel to India for a medical operation.

During Friday’s court session, Lukwago again requested to be returned to Mulago National Referral Hospital for treatment while awaiting the court’s ruling.

However, the prison officer escorting him informed the judge that he would first have to consult before any such arrangements could be made.
