The High Court Criminal Division has adjourned the treason trial of former presidential candidate Kizza Besigye after Luzira Prison authorities informed court that he was unwell and unable to attend today’s proceedings.

The development follows dramatic events on Wednesday when Dr. Besigye collapsed in the dock during court proceedings and was rushed to hospital after reportedly fainting.

Although prison authorities did not produce Dr. Besigye in court on Thursday, his co-accused, Obeid Lutale and Captain Denish Oola, were present for the hearing.

The prosecution’s first witness, Wilson Andrew Orlando, was also in court and ready to continue with his testimony.

However, State funded defence lawyer Sylvia Namwejje objected to the hearing proceeding in Dr. Besigye’s absence, arguing that he has a constitutional right to be physically present during his trial.

Presiding judge Emmanuel Baguma agreed with the objection and adjourned the case to Tuesday next week.

The judge directed prison authorities to file a medical report detailing Dr. Besigye’s health condition before the next hearing.

The prosecution also informed court that it intends to make an application when the matter resumes.

Dr. Besigye, Lutale and Oola are facing treason charges. The prosecution alleges that they conspired to overthrow the Government of Uganda through the use of firearms.
